The opinion of the court was delivered by Wayne C. Aldrich and Violet M. Chappell were jointly charged in an information containing two counts, one of felonious assault with intent to kill, maim, ravage or rob Skyler C. Rice, as defined by G.S. 1949, 21-431, the other of robbery in the first degree by taking property of Rice, as defined by G.S. 1949, 21-527. They were tried by a jury which returned a verdict of guilty on both counts. Their motion for a new trial was denied and they were sentenced as provided by statute. Thereafter they perfected an appeal specifying error in particulars which are later discussed. I
